| Abstract: | Diplomová práce se zabývá odpovědností prezidenta republiky. Základním východiskem zpracování tématu je dělení odpovědnosti na její tři části - ústavněprávní, ústavněpolitickou a trestněprávní, které pohromadě tvoří jeden komplexní celek. Tématice je věnována pozornost v kontextu právním, morálním i laickým, za neoddělitelného vztahu k dějinám, ústavnímu vývoji a východiskům změn české státnosti. Práce dále obsahuje analýzu postupu, který by mohl nastat v případě, že prezident překročí právní rámec svých pravomocí. |
| Abstract in different language: | The diploma thesis deals with the responsibility of the President of the Republic. The basics of the topic is the division of responsibility into its three parts - constitutional liability, constitutional-political and criminal responsibility, which together form a complex whole. The topic is discussed in the legal and inherent lay context, an inseparable relation to the history, constitutional development and background of changes in Czech statehood. Furthermore, thesis includes an analysis of the position and powers which the head of state possesses in law, inevitably in society. Hence, procedure that could occur in the event that the President exceeds the legal framework of his powers is included, also. |
