| Abstract: | Diplomová práce se věnuje svobodě projevu, její charakteristice, pojmům a zakotvení v ústavní pořádku České republiky. Zároveň jsou v této diplomové práci charakterizovány jednotlivé druhy a formy projevů. Blíže jsou též osvětlena hodnotící kritéria pro posuzování kolize svobody projevu, a to zejména při střetu s osobnostními právy, či s jiným právem chráněným zájmem. Nedílnou součástí posuzování svobody projevu je též judikatura Ústavního soudu ČR a Evropského soudu pro lidská práva, na níž je v diplomové práci kladen značný důraz. S problematikou svobody projevu jsou spojena i některá její úskalí, jako např. nenávistné projevy na internetu či šíření fake news, jimž je též věnována jedna kapitola diplomové práce. |
| Abstract in different language: | The thesis focuses on the freedom of expression, its characteristics, concepts and establishment in the constitutional order of the Czech Republic. At the same time, this thesis characterizes the different types and forms of speech. The evaluation criteria for assessing the conflict of freedom of expression, especially when it conflicts with personality rights or other legally protected interests, are also explained in more detail. An integral part of the assessment of freedom of expression is also the case law of the Constitutional Court of the Czech Republic and the European Court of Human Rights, which is given considerable emphasis in the thesis. Some of the pitfalls of freedom of expression are also related to the issue of freedom of speech, such as hate speech on the Internet or the spread of fake news, which are also the subject of a chapter of the thesis. |
