| Abstract: | Má diplomová práce na téma právní úprava mezinárodní silniční přepravy zboží je členěna na čtyři kapitoly, přičemž hlavními jsou druhá a třetí. Ve druhé kapitole se práce věnuje mezinárodní právní úpravě silniční přepravy zboží a třetí kapitola se věnuje hlavním smluvním typům českého práva v oboru přepravy zboží. V mezinárodní části práce vymezuje pojmy, se kterými se lze v oblasti přepravy setkat a stanovuje právní rámec. V této kapitole se podrobně rozebírají jednotlivé mezinárodní smlouvy. Nejdůležitější část je o Úmluvě o přepravní smlouvě v mezinárodní silniční nákladní dopravě (CMR). Úmluva totiž upravuje základní podmínky pro sestavení přepravní smlouvy, odpovědnost za škodu na zásilce, náhradu škody a další. V následující části popisuje některé další klíčové mezinárodní smlouvy. V české části je vymezeno, která ustanovení českého práva jsou relevantní pro přepravu zboží. Důraz je kladen na smlouvu o přepravě věci a smlouvu zasílatelskou dle obchodního zákoníku. |
| Abstract in different language: | My thesis on the topic The legislation of the international road transportation of goods is divided into four chapters and the main are the second and the third one. The thesis is dedicated to the international legislation of the road transportation of goods in the second chapter and to the main contractual types of czech law in the field of the road transportation of goods in the third chapter. The thesis defines the concepts which can occure in the field of transportation and sets up legal scope in the international chapter. There is detailed analyze of each of the international contracts described in this chapter. The most important part is the one on Convention on the Contract for the International Carriage of Goods by Road (CMR). The Convention namely edits basic conditions for the setting up the transportation contracts, liability to the damage on the consignement, compensation for the damage etc. In the following part is defined which provisions of the czech law are relevant to the transportation of goods. The stress is layed down on to the contract of transportation and the contract of consignment due to the commerce code. |
