| Abstract: | V této práci je proveden detailní rozbor skutkových podstat trestných činů proti životu a zdraví spáchaných nedbalostním zaviněním definovaných v aktuální právní úpravě trestního práva České republiky, s návazností na v právní praxi nejčastěji zastoupené oblasti s výskytem těchto trestných činů jako jsou oblasti dopravních nehod, zdravotnických služeb a pracovních úrazů, v kombinaci s těmito oblastmi souvisejícími právními předpisy a judikaturou. V neposlední řadě je v této práci provedeno srovnání právních úprav předmětných trestných činů v právní úpravě České republiky a Slovenské republiky. Závěrem jsou uvedeny ve vztahu k tématu této práce úvahy autora de lege ferenda a zhodnocení předmětné problematiky. |
| Abstract in different language: | An analysis of the issues of crimes against life and health caused by negligence from the point of view of legal theory, the historical development of their legal regulation, their current legal regulation in the system of valid criminal law in the Czech Republic, a detailed analysis of criminal law in relation to legal practice and the case-law of the most frequently represented areas in terms of the occurrence of these crimes, all with a focus on the material-legal area, was written in this work. Last but not least, a comparison of the legal regulations of these crimes existing in systems of criminal law of the Czech Republic and the Slovak Republic, and thoughts de lege ferenda in relation to the topic of this thesis, were made there. A detailed analysis of the facts of the crimes against life and health caused by the negligence defined in the current legal regulation has been carried out in this thesis, including the legal practice of the most frequently represented areas with the occurrence of these crimes, such as traffic accidents, health services and occupational accidents. |
