| Abstract: | Diplomová práce je zaměřena na význam provázanosti poučovací povinnosti a zákonné koncentrace ve sporném řízení podle části první až třetí zákona č. 99/1963 Sb., občanský soudní řád. V práci jsou vymezeny základní pojmy poučovací povinnosti a zákonné koncentrace a především je provedena analýza způsobu poučení o zákonné koncentraci a důsledkům při absenci nebo nesprávném poučení. Dále je zhodnocen vliv poučení na základě § 118a odst. 1-3 na koncentraci řízení a následky při nesplnění tohoto poučení. |
| Abstract in different language: | This diploma thesis focuses on the importance of the interconnection of the information duty of the court and the legal concentration in the lawsuit under the first to third part of Act No. 99/1963 Coll., The Civil Procedure Code. The thesis defines the basic concepts of informational duties of the court and legal concentration and, above all, analyzes the way of instruction about legal concentration and the consequences of its absence or misinstruction. Further, the influence of information duty under Section 118a para 1-3 on the concentration of proceedings and the consequences of non-compliance with this instruction is evaluated. |
