| Abstract: | Cílem této diplomové práce je poskytnout čtenáři stručný přehled o iráckém rodinném právu a jeho vývoji od roku 1959 včetně důležitých úprav ze strany Kurdské Regionální Vlády. Část práce bude dále věnována vybraným článkům zákona, jejich případné problematice včetně komparace s praxí v prostředí Iráckého Kurdistánu. Pokusím se zjistit, proč i nadále přetrvávají vybrané fenomény (např. dětské sňatky), jaké to s sebou přináší problémy a zda dochází k právním postihům. Dále mě bude zajímat jestli existují snahy tyto přetrvávající trendy eliminovat a jakým způsobem k tomu dochází. Nastíněna bude rovněž podoba kurdského aktivismu na poli ženské otázky a rodinného práva. |
| Abstract in different language: | The aim of the thesis is to provide the reader a brief overview of Iraqi family law and its development since 1959, including important modifications of the Kurdish regional government. Part of the work will be devoted to selected articles of the law, their possible issues, including comparison with the practice in Iraqi Kurdistan. I will try to find out why there are still selected phenomena (eg child marriage), what the connected problems are and whether there are legal sanctions. Furthermore, I will be interested to see if there are efforts to remove these persistent trends and how this happens. The form of Kurdish activism in the field of women's issues and family law will also be outlined. |
