| Abstract: | Diplomová práce se zabývá institutem vyživovací povinnosti, přičemž je detailně zaměřena na vyživovací povinnost mezi manžely, rozvedenými manžely, registrovanými partnery a registrovanými partnery po zrušení partnerství. Diplomová práce je rozdělena do pěti kapitol. Po úvodní kapitole následuje obecné vymezení vyživovací povinnosti. V této kapitole je popsán historický vývoj právní úpravy tohoto institutu od roku 1811, platná právní úprava, zásady společné pro všechny druhy vyživovací povinnosti a druhy vyživovací povinnosti, které nejsou stěžejním tématem této práce. Třetí kapitola se pak zabývá vybranými druhy vyživovací povinnosti, a to jejich vznikem, výší, rozsahem, splatností, zánikem a procesními aspekty soudních řízení týkajících se nároků na výživné. Poslední část práce obsahuje srovnání s právní pravou vybraných druhů vyživovací povinnosti na Slovensku. Diplomová práce obsahuje úvahy de lege ferenda. |
| Abstract in different language: | The diploma thesis deals with the institute of maintenance obligations with a detailed focus on the maintenance obligations between husbands, divorced husbands, registered partners and registered partners after the cancellation of the partnership. The diploma thesis is divided into five chapters. The second chapter deals with the maintenance obligation in general. This chapter is describes the historical development of the legal regulation of this institute since 1811, the current legal regulation, the principles common to all types of the maintenance obligations and types of maintenance obligations that are not the main topic of this diploma thesis. The third chapter deals with selected types of maintenance obligations. For each of the selected types of maintenance, the origin, amount, scope, extinction and procedural aspects of the maintenance obligation are discussed. The last chapter is focused on the comparison of Czech and Slovak legislation of selected types of maintenance obligations. The diploma thesis contains considerations de lege ferenda. |
