Abstract: | Cílem této diplomové práce je analýza práva na život jak z hlediska českého ústavního práva, tak z hlediska práva mezinárodního a jeho zakotvení ve vybraných ústavách evropských států. Popisuje charakter práva na život jakožto základního lidského práva, které je garantované každému jedinci od narození do smrti bez rozdílu. Obsahem je taktéž otázka doktríny nedotknutelnosti osoby a její jednotlivé aspekty. Následuje podrobný rozbor jednotlivých odstavců článku 6 Listiny základních práv a svobod. V této souvislosti se práce zaměřuje i na chápání trestu smrti v českém právním řádu. Kapitola vybrané recentní problémy je věnována problematice interrupce čili umělého přerušení těhotenství a problematice euthanasie. Zaměřuje se zejména na způsoby legislativního řešení přípustnosti interrupce a euthanasie, ale i zakotvení v české právní úpravě. V kapitole náměty de lege ferenda práce pojednává o legislativní snaze legalizace euthanasie v České republice v souvislosti s návrhem zákona o důstojné smrti. |
Abstract in different language: | The aim of this dissertation is to analyze the right to life embedded in the Czech constitutional law as well as in the international law and chosen constitutions of some European countries. It describes the right to life as the fundamental human right guaranteed to every person from birth to death without exception. It also deals with the doctrine of inviolability of a person and its various aspects. It is followed by a detailed analysis of individual paragraphs of Article 6 of the Charter of Fundamental Rights and Freedoms. The dissertation also focuses on the understanding of death penalty in the Czech law. One chapter is dedicated to abortions and euthanasia. In particular, it looks at the legislative solutions for the access to abortions and euthanasia and how it is embedded in the Czech law. Chapter de lege ferenda deals with legislative efforts to legalize euthanasia in connection with the bill on dignified death. |
